The GST journey jump-started in the year 2000 during the then Prime Minister Mr. Atal Bihari Vajpayee where a new committee was formed to draft this law. It took 17+ years for this law to progress. Finally, in the year 2017, the GST bill was passed in the Lok Sabha and Rajya Sabha.

GST implementation was criticized by all the industries/financial institutions, media, and opposition political parties in India. The World Bank’s 2018 update on India’s development described India GST as very complicated, as they found various differences as compared to other countries. Question 1:- What is your understanding when we say “taxable event” under GST?

Answer:-  CGST & SGST will be levied on all Intra state supplies and on Inter-state IGST will be levied on all supplies. Section 7 (1) of the CGST/SGST Act and Section 4 (1) of the IGST Act are charged.

Question 2:- The reverse charge mechanism is chargeable only to services and not for goods. (True/False)

Answer:-  False. The reverse charge mechanism is chargeable to both goods and services.

Question 3:-  Elaborate your understanding of remission of tax/duty?

Answer:-  Remission of tax/duty means the obligation to pay the tax relief is received by the taxpayer in case the goods are lost or damaged due to any natural calamities. 

The remission levied is subject to certain conditions laid down.

Question 4:- Is remission allowed under GST law?

Answer:-  Absolutely Sir, Section 11 and Model GST law permits tax remission to be levied on any supply of goods.

Question 5:-  Is Composition Tax collected from customers?

Answer:- No. The person taxable under the composition scheme cannot collect tax and also be noted that no invoice of any kind can be issued.

Question 6:- What is the ceiling for opting to pay under the composite scheme?

Answer:- The ceiling is 50 lacs in aggregate in a financial year

Question 7:- What are the penal charges if a taxable person violates any condition and is not eligible to pay tax under the composition scheme?

Answer:- The person paying the tax who was not eligible to pay tax under the composition scheme would have to pay tax interest and in addition a penalty equivalent to the tax amount section 8(3) of MGL.

Question 8:-  Who authorizes the levy of GST?

Answer:-  Constitution (101st Amendment) Act 2016, Parliament and the state legislatures to make laws with respect to GST was granted by Article 246 A.

The sole right of the Parliament to legislate with respect to the inter-state is  as per Article 246A read with Article 269A

Question 9:- “Input” what is this term in GST?

Answer:- GST levied on purchase in GST Input.

Question 10:-  What is GST Payable?

Answer:- GST Output – GST Input = GST Payable

GST is classified into 4 types:-

  1. SGST- State goods and service tax
  2. CGST- Central goods and service tax
  3. IGST- Integrated goods and services tax
  4. UGST- Union goods and service tax

State Goods and service tax:-

SGST is imposed by the state government on intrastate goods and service affairs and the revenue generated is earned by the state government, where the transaction has happened. SGST includes taxes like VAT, Entertainment Tax, Luxury Tax, Octroi, Tax on the lottery, and Purchase Tax.

In Andaman and Nicobar Islands or Chandigarh, the union territories UGST replaces SGST

CGST is imposed by the central government on intrastate goods and service affairs. The Central Government collects this revenue. CGST is imposed along with CGST and UGST. The central and the state government share the revenues. e.g. A Bangalore-based dealer selling your goods or service to a Bangalore-based dealer both CGST and SGST will be imposed, as this transaction is an intrastate transaction. If the transaction is for a value of 40,000 and 18% GST is applied, the central and the state government will share the GST amount collected in equal proportion.

IGST is the tax imposed on inter-state goods and services affairs. It is applied to all imports and exports. The central and the state government share the revenue generated.

UGST is the tax generated by the Union territories for the affairs in the territory. Andaman and Nicobar Islands, Dadra and Nagar Haveli, Chandigarh, Lakshadweep, and Daman, and Diu are our union territories. This tax is similar to SGST.

Question 11:- What is GST credit?

Answer:-  As and when the GST Output is less than the GST Input then it’s termed as GST Credit.

Answer:-  

CGST:-  CGST is the Tax collected by the Central Government for an Intra-state sale i.e a sale that is happening in Maharashtra.

SGST:-  It is the Tax collected by the State Government for an Intra-state sale i.e. a sale happening in Maharashtra.

IGST:- The Tax collected by the Central Government for an Inter-state sale. E.g. A sale that happens from Kochi to Maharashtra.

Question 13:- What do you understand about the GST Output?

Answer:- GST levied on the sales also called the GST Liability is the GST Output.

Question 14:- Is it possible that you can adjust CGST credit and SGST credit against each other?

Answer:- Both CGST and SGST cannot be adjusted against each other.

Question 15:- List  3 disadvantages of GST?

Answer:-  1)  Returns need to be filed

    2)  Complicated filing returns

Answer:-  1.SericeTax, 2.Central excise tax,3.Countervailing tax, 4. Special countervailing duty, 5. Value-added tax, 6.Central Sales tax, and more.

Question 17:-  What is the difference between UPA’s GST and NDA’s GST?

Answer:- The prominent difference is that the Petroleum sector is excluded from the GST circle. Liquor used for human consumption is excluded however tobacco and tobacco products will fall under GST.

Question 18:- List the procedures in Adjustment of  IGST with CGST and SGST?

Answer:- GST Input adjustment with IGST Output is done if:-

  1. Input IGST- if it exists
  2. Input CGST-  if it exists
  3. Input SGST –  if it exists 

Question 19:- List the various invoices under GST

Answer:- a) The invoices will start for local and central sales with the same series number.

b) The sale to registered and unregistered people will have the same series.

c) Tax invoice should be issued for any kind of taxable sales

d) Invoice for exempted goods

e) Sale by a dealer that does not under composition scheme

Question 20:- What are the repercussions if we purchase goods from unregistered dealers?

Answer:- ITC is not received by the person receiving the goods. The people will have to pay tax under reverse charge registered under composition schemes.
